Nansuka LLC ("we," "us," or "our") sets forth the following Terms of Service for our mobile application and related services (the "Service"). By using the Service, you agree to these Terms.

Nansuka LLC（以下「当社」）は、当社が提供するモバイルアプリケーションおよびこれに関連するサービス（以下「本サービス」）の利用条件を、以下のとおり定めます。ユーザーは、本サービスを利用することにより、本規約に同意したものとみなされます。

1. Scope of Application 適用範囲

These Terms apply to all relationships between you and us regarding your use of the Service.

本規約は、本サービスの利用に関する当社とユーザーとの間の一切の関係に適用されます。

2. Description of the Service 本サービスの内容

The Service includes AI-assisted conversations, character-based interactions, topic presentation, creative or entertainment-oriented content, and related features. We may add, modify, suspend, or discontinue any aspect of the Service, including its content, specifications, features, name, or design, at any time.

本サービスは、AIを利用した会話、キャラクター表現、話題提示、創作的または娯楽的なコンテンツ提供その他これらに関連する機能を含みます。当社は、本サービスの内容、仕様、機能、名称、デザインその他の要素を、必要に応じて追加、変更、中断または終了することができます。

3. Accounts アカウント

You may be required to create or link an account to use the Service. You are responsible for safeguarding your account information and must promptly notify us of any unauthorized use.

You may request deletion of your stored data through the in-app account deletion feature.

ユーザーは、当社または当社が指定する方法により、本サービスの利用に必要なアカウントを作成または連携する場合があります。ユーザーは、自らの責任においてアカウント情報を管理するものとし、第三者による不正利用があった場合には、速やかに当社へ連絡するものとします。

ユーザーは、アプリ内のアカウント削除機能により、保存されたデータの消去を請求することができます。

4. Prohibited Conduct 禁止事項

You must not:

• violate applicable laws or public order and morals
• infringe the rights, interests, reputation, credit, or privacy of us or any third party
• interfere with the operation of the Service
• engage in unauthorized access, reverse engineering, scraping, bot usage, or similar conduct
• exploit bugs, loopholes, or operational gaps in the Service for unfair gain
• submit false information
• engage in any other conduct we reasonably deem inappropriate

ユーザーは、以下の行為を行ってはなりません。

• 法令または公序良俗に違反する行為
• 当社または第三者の権利、利益、名誉、信用、プライバシーを侵害する行為
• 本サービスの運営を妨害する行為
• 不正アクセス、リバースエンジニアリング、スクレイピング、ボット利用その他これらに類する行為
• 本サービス上の不具合、仕様または運用上の抜け穴を利用して不当な利益を得る行為
• 虚偽情報の登録または入力
• 当社が不適切と合理的に判断する行為

5. AI-Generated Content and Fiction Notice AI生成コンテンツおよびフィクション表現に関する注意事項

The Service may include text, dialogue, suggestions, topics, world-building elements, storylines, and other content generated, summarized, transformed, or presented through artificial intelligence or other automated systems. Because such content may involve automated generation or statistical inference, it may not always be accurate, complete, current, or reflective of real-world facts.

Characters, conversations, reactions, settings, stories, and other content within the Service may include creative, dramatic, entertainment-oriented, or fictional elements. You understand and agree that the Service is not intended to provide factual truth, investigative findings, news reporting, professional evaluation, diagnosis, or guarantees.

The Service does not provide medical, legal, tax, investment, crisis-response, mental health, or other professional advice. You should seek qualified professional or official assistance where appropriate. Do not rely on the Service alone for important decisions.

We make no warranty as to the accuracy, truthfulness, completeness, usefulness, or fitness for a particular purpose of any AI-generated or fictional content. You use the Service at your own discretion and risk.

本サービスには、人工知能その他の自動処理により生成、要約、変換または提示される文章、会話、応答、提案、話題、世界観、ストーリー、演出その他のコンテンツが含まれる場合があります。これらのコンテンツは、自動生成または統計的推定を含む性質上、必ずしも正確、完全、最新または現実世界の事実に対応したものではありません。

本サービスに登場するキャラクター、会話、反応、設定、物語、表現その他のコンテンツには、創作的、演出的、娯楽的またはフィクションとして構成された要素が含まれます。ユーザーは、本サービスが真実の事実関係、真相、報道、記録、診断、鑑定または保証を提供するものではないことを理解し、これに同意するものとします。

本サービス上の情報は、医療、法律、税務、投資、危機対応、メンタルヘルス、緊急対応その他の専門的助言を構成するものではありません。ユーザーは、重要な判断を行う場合には、必要に応じて有資格の専門家、公的機関または適切な窓口に相談するものとします。

当社は、AI生成コンテンツまたはフィクション表現の正確性、真実性、完全性、特定目的適合性または有用性を保証しません。ユーザーは、自らの判断と責任において本サービスを利用するものとします。

6. Age Restrictions 年齢制限

You must be at least 13 years old to use the Service. If you are at least 13 but under the age of majority in your jurisdiction, you may use the Service only with the consent of your parent or legal guardian.

13歳未満の方は本サービスを利用することができません。13歳以上の未成年者が本サービスを利用する場合には、法定代理人その他保護者の同意を得たうえで利用するものとします。

7. Paid Features, Subscriptions, and Premium Coins 有償機能、サブスクリプションおよびプレミアムコイン

The Service may include paid features, subscriptions, in-app purchases, premium coins, and other digital benefits. Their content, price, grant conditions, availability period, and scope of use are governed by the purchase screen, in-app notices, disclosures required by applicable commercial law, or other conditions we specify.

Unless required by law or expressly permitted by us, premium coins and other digital benefits may not be redeemed for cash, transferred, refunded, or converted into monetary value.

本サービスには、有償機能、サブスクリプション、アプリ内課金、プレミアムコインその他のデジタル特典が含まれる場合があります。これらの内容、価格、付与条件、利用可能期間および利用範囲は、購入画面、本サービス内表示、特定商取引法に基づく表示または当社が別途定める条件に従います。

プレミアムコインその他のデジタル特典は、法令または当社が明示的に認める場合を除き、換金、譲渡、払戻しまたは現金化することはできません。

8. Refunds, Cancellations, and Premium Coin Adjustments 返金、キャンセルおよびプレミアムコインの取扱い

For subscriptions, in-app purchases, and other paid digital content purchased through Apple's App Store, payment processing, billing, cancellation, and refunds are handled by Apple or Apple's designated payment provider.

Requests for refunds, billing reversals, payment method changes, and other payment-related procedures for App Store purchases must generally be made directly by the user through Apple's designated process.

If a refund, cancellation, chargeback, or similar reversal is processed for an App Store purchase, we may deduct, cancel, invalidate, or suspend all or part of the premium coins, paid features, benefits, access rights, or other digital entitlements granted in connection with the refunded transaction.

Any action described above will, in principle, be limited to the scope of the refunded or reversed transaction and will not automatically affect separate paid benefits that were lawfully obtained and are unrelated to that transaction.

If any premium coins or benefits associated with the refunded transaction have already been used in whole or in part at the time of the refund or reversal, we may, to the extent permitted by applicable law, offset such amounts against future benefits, suspend related entitlements, or take other reasonable measures necessary to address the reversal. However, unless expressly stated otherwise, we will not require you to make any additional monetary payment solely because such benefits have already been consumed.

We may update premium coin balances, available features, displayed content, or account status to reflect any refund or reversal.

If refund requests or refund processing are repeated on an ongoing basis, or if we reasonably determine that fraudulent activity, abuse, or operational risk exists, we may, with prior or subsequent notice as appropriate, suspend the granting of premium benefits, exclude the account from promotions, request account verification, or limit access to all or part of the Service.

To the extent a transaction is treated as a distance sale under applicable law, no statutory cooling-off right applies unless otherwise required by law. Conditions relating to returns, cancellations, refunds, and the cancellation of benefits are governed by these Terms, our disclosures required by applicable commercial law, the purchase screen, and any conditions presented by us or Apple.

AppleのApp Storeを通じて購入されたサブスクリプション、アプリ内課金その他の有償デジタルコンテンツに関する決済、請求、解約および返金の処理は、AppleまたはAppleが指定する決済手段の提供者を通じて行われます。

App Store経由の購入に関する返金申請、請求取消し、決済方法の変更その他の支払関連の手続は、原則としてユーザーご自身でApple所定の方法により行うものとします。

App Store経由の購入について返金、取消し、チャージバックその他これらに類する処理が行われた場合、当社は、当該返金等の対象となった取引に対応して付与されたプレミアムコイン、有償機能、特典、利用権その他のデジタル利益の全部または一部を、減算、取消し、無効化または利用停止することができます。

前項の措置は、原則として当該返金等の対象取引に対応する範囲で行うものとし、当該返金等と無関係に適法に取得された別個の有償特典に当然に影響を及ぼすものではありません。

返金等の時点で、当該返金等の対象取引に対応するプレミアムコインまたは特典が既に全部または一部消費されている場合であっても、当社は、法令上認められる範囲で、将来付与予定の特典との相殺、当該返金等に係る特典の停止その他合理的に必要な措置を講ずることができます。ただし、当社は、別途明示しない限り、当該消費済み部分のみを理由として、ユーザーに対し追加の金銭支払を請求しません。

当社は、返金等の反映に伴い、プレミアムコイン残高、利用可能機能、表示内容またはアカウント状態を変更する場合があります。

当社は、返金申請または返金処理が反復継続して行われる場合、その他不正利用、濫用または本サービスの運営上のリスクがあると合理的に判断した場合には、事前または事後の通知のうえ、プレミアム特典の付与停止、キャンペーン適用除外、アカウント確認の実施または本サービスの全部もしくは一部の利用制限を行うことができます。

本サービスのうち通信販売に該当する取引については、法令に別段の定めがある場合を除き、法定のクーリング・オフ制度は適用されません。返品、解約、返金、特典の取消しその他の条件については、本規約、特定商取引法に基づく表示、購入画面その他当社またはAppleが表示する条件に従うものとします。

9. Service Discontinuation, Digital Benefits, and In-Service Data サービス終了、デジタル特典およびデータの取扱い

Premium coins, subscription benefits, conversation history, character states, unlocked features, images, effects, and any other digital content or in-service benefits made available through the Service do not transfer any ownership or property right to you unless required by applicable law. They are provided solely as a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license for use within the Service.

You acknowledge that digital elements, progress, history, benefits, and account states associated with the Service may be modified, suspended, deleted, expire, or become unavailable due to operation of the Service, feature changes, maintenance, incident response, legal compliance, or discontinuation of the Service.

We may permanently or temporarily discontinue, suspend, modify, or shut down all or part of the Service for business, technical, legal, security, or operational reasons. Where reasonably practicable, we will endeavor to provide advance notice through the Service, our website, email, push notification, or other reasonable means.

If you cancel a subscription, delete the app, stop using the Service, or otherwise terminate your use for your own convenience, we do not provide prorated or partial refunds except where required by applicable law or permitted through Apple or another payment provider.

If we permanently discontinue the Service, subscriptions, paid features, premium coins, and other paid digital entitlements will be handled in accordance with applicable law, the processes and rules of Apple's App Store or any other payment platform, and our reasonable operational requirements.

Except where required by applicable law, we are not obligated to provide cash refunds, monetary compensation, or cash-out value for unused premium coins, unused benefits, inaccessible digital elements, conversation history, progress, or other in-service data as a result of suspension, modification, or discontinuation of the Service. This does not limit any non-waivable rights you may have under applicable law.

本サービス上で付与、表示または利用可能となるプレミアムコイン、サブスクリプション特典、会話履歴、キャラクター状態、開放要素、画像、演出、その他一切のデジタルコンテンツまたはデジタル上の利益は、法令上別段の定めがある場合を除き、ユーザーに対して所有権その他の財産権を移転するものではなく、本サービス内でのみ利用可能な、限定的、非独占的、譲渡不能、再許諾不能かつ取消可能な利用権として提供されるものとします。

ユーザーは、本サービス上のデジタル要素、進行状況、履歴、特典またはアカウント状態が、本サービスの提供、運営、仕様変更、保守、障害対応、法令対応またはサービス終了等に伴い、変更、停止、消去、失効または利用不能となる場合があることを、あらかじめ了承するものとします。

当社は、事業上、技術上、法令上その他の理由により、本サービスの全部または一部を恒久的または一時的に終了、中止、停止または変更することがあります。この場合、当社は、合理的に可能な範囲で、事前に本サービス上、当社ウェブサイト、電子メール、プッシュ通知その他当社が適当と認める方法により周知するよう努めます。

ユーザー都合によるサブスクリプションの解約、中途退会、アンインストールその他これらに類する事由については、法令上必要な場合またはAppleその他決済事業者の条件により認められる場合を除き、既払料金の日割り、月割りその他の方法による返金は行いません。

当社が本サービスを恒久的に終了する場合、サブスクリプション、有償機能、プレミアムコインその他の有償デジタル特典の取扱いについては、適用法令、AppleのApp Storeその他の決済プラットフォームの仕組みおよび条件、ならびに当社が合理的に必要と判断する運営上の対応に従って処理されるものとします。

当社は、法令上必要な場合を除き、本サービス終了、中止、停止または変更に伴い、未使用のプレミアムコイン、未使用の特典、利用不能となったデジタル要素、会話履歴、進行状況その他のアプリ内データについて、換金、現金払戻し、金銭補償またはこれに準ずる補填を行う義務を負いません。ただし、当社の故意または重過失による場合その他法令により別段の定めがある場合は、この限りではありません。

10. Intellectual Property 知的財産権

All copyrights, trademarks, know-how, database rights, and other intellectual property rights in the Service belong to us or our licensors. You may not reproduce, republish, modify, distribute, publicly transmit, or otherwise use any content of the Service without our prior permission.

本サービスに関する著作権、商標権、ノウハウ、データベース権その他一切の知的財産権は、当社または正当な権利者に帰属します。ユーザーは、当社の事前の承諾なく、本サービスに含まれるコンテンツを複製、転載、改変、配布、公衆送信その他の方法で利用してはなりません。

11. Suspension, Interruption, or Modification of the Service サービスの停止、中断または変更

We may suspend, interrupt, or modify all or part of the Service without prior notice when necessary for maintenance, incident response, system updates, legal compliance, security, or other operational reasons.

当社は、保守、障害対応、システム更新、法令対応、セキュリティ対応その他の必要がある場合、ユーザーへの事前通知なく、本サービスの全部または一部を停止、中断または変更することがあります。

12. Disclaimers 免責

We provide the Service on an "as is" and "as available" basis and make no express or implied warranties that it will fit your particular purpose or have expected functionality, merchantability, accuracy, usefulness, completeness, continuity, or security, or that it will be free from defects, errors, interruptions, or third-party rights violations.

To the maximum extent permitted by law, we are not liable for damages arising from your use of or inability to use the Service, except where caused by our willful misconduct or gross negligence. This does not apply where applicable law prohibits such limitation.

当社は、本サービスがユーザーの特定の目的に適合すること、期待する機能・商品的価値・正確性・有用性・完全性・継続性・安全性を有すること、ならびに不具合、エラー、中断または第三者による権利侵害が生じないことについて、明示または黙示を問わず保証しません。

当社は、当社の故意または重過失による場合を除き、本サービスの利用または利用不能に起因してユーザーに生じた損害について責任を負いません。ただし、法令により当該免責が制限される場合は、この限りではありません。

13. Measures for Violations 規約違反時の措置

If you violate these Terms, we may, with or without prior notice, delete content or data, restrict features, suspend use, suspend the account, or take any other necessary and reasonable measures.

ユーザーが本規約に違反した場合、当社は、事前通知の有無を問わず、投稿・データの削除、機能制限、利用停止、アカウント停止その他当社が必要かつ合理的と判断する措置を講ずることができます。

14. Changes to These Terms 規約の変更

We may revise these Terms when necessary. If we make material changes, we will provide notice through the Service, on our website, or by other methods we deem appropriate. Continued use of the Service after such changes constitutes acceptance of the revised Terms.

当社は、必要に応じて本規約を変更することができます。重要な変更を行う場合には、本サービス内表示、ウェブサイト掲載その他当社が適当と判断する方法により周知します。変更後にユーザーが本サービスを利用した場合、変更後の規約に同意したものとみなされます。

15. Governing Law and Jurisdiction 準拠法および管轄

These Terms are governed by the laws of Japan. Any dispute arising between you and us in connection with the Service or these Terms shall be subject to the exclusive jurisdiction of the court having jurisdiction over our principal place of business as the court of first instance, unless otherwise required by applicable law.

本規約は日本法に準拠します。本サービスまたは本規約に関連して当社とユーザーとの間に生じた一切の紛争については、当社本店所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。ただし、法令により別段の定めがある場合は、この限りではありません。
